What is Litigation Funding?
Litigation funding, also known as legal financing or third-party funding, is now a well-established practice in Australia, enabling individuals and businesses to pursue legal action without the burden of upfront costs. It allows claimants to secure the necessary funds to cover their legal expenses, including solicitor’s fees, court costs, expert witness fees, and other litigation expenses.
In the litigation finance space, our commitment is generally restricted to a budget which has been assessed and agreed in conjunction with the Croy Legal team, to ensure that where possible, funding is not exhausted before the claim process is complete.
We agree on a percentage of the recovery sum in return from the settlement or court judgment in your favour. lf the case is lost, we usually bear the overall costs, so we generally look for a return that reflects the risks taken.

1. Application
Anyone can submit an enquiry to apply for our litigation funding service. Use our simple form below and send us the brief details of your case. In conjunction with Croy Legal, we will execute an NDA (non-disclosure agreement) for confidentiality, and then the legal team will prepare an initial overview and outline the merits of the case.
2. Evaluation
We will evaluate the application to determine if funding can be approved, along with preparing clear pricing and any terms of agreement. At this stage we may ask for further details to ensure we have completed our due diligence.
3. Funding Agreement
Upon approval, a funding agreement is drafted. This agreement outlines the terms, including the amount of funding provided, the fee structure, and the repayment conditions.
4. Moving Forward
Once all parties agree and the documents are signed, the case can now be pursued. If litigation funding was declined, we will discuss any further options with the legal team for them to share with you.
